Terms of Service
Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the AlbaJet platform and services, you agree to comply with and be bound by these Terms.
- Definitions
- Aircraft:
- any vehicle, with or without an engine, that can fly, such as a plane or helicopter in connection to the agreed flight.
- Aircraft Operator:
- the Aircraft Operator whose quotation for provision of flight to the Customer has been accepted by the Customer in accordance and agreement with the terms on www.albajet.com as detailed in the Charter Contract.
- Cancellation:
- the request of the Customer to cancel any flight(s) after a Charter Contract has been confirmed.
- Charter Contract:
- the legally-binding contract between AlbaJet and the Customer, whereby the Customer agrees to the full conditions of the aircraft charter as defined by said contract.
- Charter Invoice:
- the invoice issued by AlbaJet to the Customer setting out the Charter Price, payment terms, currency, and bank details for payment.
- Charter Price:
- the price agreed to by the Customer for the charter trip, as stated in the Charter Contract.
- Confirmation:
- a Charter Contract will be deemed to be confirmed when the full Charter Price, or any deposit as specified in the Charter Contract, has been received by AlbaJet, unless otherwise agreed.
- Customer:
- the AlbaJet Customer (including its representative(s) as applicable) whose details are listed in a Charter Contract.
- De-Icing Waiver:
- a non-refundable fee purchased by the Customer at the time of booking which covers the cost of aircraft de-icing if required. No refund shall be due if de-icing is not performed.
- Flight:
- all flights detailed in the Charter Contract, including any empty positioning flights required by the Aircraft Operator to execute the agreed contract.

Scope of AlbaJet services
AlbaJet Charter GmbH is an online private jet quotation platform, which enables the Customer to obtain price estimates and to book private charter flights provided by a range of Aircraft Operators. AlbaJet acts exclusively as an intermediary and broker. AlbaJet is not an Aircraft Operator, does not operate aircraft, and does not act as a carrier. The actual carriage by air is performed by the Aircraft Operator, who remains solely responsible for the operation of the flight.
Once the Charter Contract has been confirmed, AlbaJet will fully support the Customer in its position as an intermediary.

Validity of Quotes
A quotation is legally non-binding until an agreement has been made between the Customer and AlbaJet in the form of a Charter Contract. AlbaJet reserves the right to withdraw quotations, even after receipt by the Customer.

Cancellation
In the event that the Customer requests to cancel any of the agreed flight(s) in the Charter Contract, the Customer shall pay the following compensation:
- 50% of the full Charter Contract price after the Charter Contract has been signed
- 100% of the full Charter Contract price if cancelled within 15 days of the scheduled departure time of the first flight agreed in the Charter Contract

Charter terms
AlbaJet acts exclusively as a facilitating agent between the Customer and the Aircraft Operator. AlbaJet's remuneration for its services is included in the Charter Price.
- 5.1
- The Customer shall pay AlbaJet the agreed Charter Price, as agreed in the Charter Contract, in the currency and to the bank address provided in the Charter Invoice.
- 5.2
- All agreed prices are subject to industry and related fuel price fluctuations. If the fuel price changes by more than 5% between the time of agreement and the date of flight, the Charter Price may be adjusted accordingly and is payable by the Customer. AlbaJet shall notify the Customer of any such adjustment as soon as reasonably practicable.
- 5.3
- The Charter Price agreed in the Charter Contract excludes aircraft de-icing, ground transportation services, inflight Wi-Fi, SATCOM services, special catering requests, and VIP terminal fees, unless explicitly stated in the Charter Contract and agreed to by AlbaJet.
- 5.4

If the Aircraft Operator is unable to perform a flight in accordance with the Charter Contract due to an
aircraft technical issue, war, warlike events, insurrection, terrorist action, accidents with aircraft,
force majeure of any nature (including but not limited to pandemics, epidemics, volcanic activity,
airspace closures, government travel bans, sanctions, or cyberattacks), or events outside of the control
of the Aircraft Operator and/or AlbaJet, AlbaJet shall use its reasonable commercial endeavours to find
a suitable aircraft replacement, and shall disclose any extra costs to the Customer.
If AlbaJet's efforts to find a replacement aircraft are successful, but rejected by the Customer, then AlbaJet shall be entitled to the full Charter Price agreed in the Charter Contract.
If AlbaJet's efforts to find a replacement aircraft are unsuccessful, the Customer's sole remedy shall be a full refund of the Charter Price. In the case of any refund, the refund amount will be calculated on a pro-rata basis based on the percentage of the trip flown.
For example, if 4 hours of a total of 10 flight hours were unavailable, the Customer would be due a refund for 40% of the agreed Charter Price. - 5.5
- All Charter Contracts are based on internationally recognised ICAO and IATA airport codes, and not by airport names which may be subjected to incorrect interpretation and change.
- 5.6
- AlbaJet shall not be liable to the Customer in the event of non-carriage due to customs, police, health, immigration, or other legal regulations of any state to or from which the aircraft is to be flown.

AlbaJet uses its reasonable commercial endeavours to help the Customer identify all the statutory travel requirements in force
at the time of the flight. These requirements may include the possession of valid passports, visas and/or
health certificates ("adequate travel documents") to be presented by all passengers to the appropriate state
authorities on both departure and arrival. However, it remains the responsibility of the Customer to ensure
that all passengers are in possession of adequate travel documents.
Full passenger details, including passport scans or photographs, must be provided to AlbaJet no later than 48 hours before the scheduled departure. Passenger details provided as plain text (e.g. typed in an email) will not be accepted. Last-minute passenger changes or additions cannot be guaranteed and may not be accepted.
For all international General Aviation flights to or from the United Kingdom, passenger information must be submitted no later than 2 hours prior to the expected time of departure or arrival, in accordance with UK border regulations.
If a passenger is denied boarding on departure, or entry on arrival, due to failure to present adequate travel documents, the Customer will be liable for any additional costs incurred by that passenger. If the Aircraft Operator is unable to perform a flight because a passenger fails to present adequate travel documents, the flight will be considered to have been cancelled by the Customer, and the above Cancellation terms will apply. - 5.8
- The Customer is liable for any charges incurred in restoring any damage or soiling to any part of the Aircraft, equipment or its interior which is caused by the passenger(s) or any animals travelling with them.
- 5.9
- The full Charter Price, or any deposit as specified in the Charter Contract, must be received by AlbaJet by the date(s) stipulated in the Charter Contract. Payments received by AlbaJet are held on behalf of the Customer for the purpose of settling the charter arrangements and are not held in trust or escrow. Time of payment shall be of the essence. Failure to make payment by the due date may result in the cancellation of the Charter Contract, and the Cancellation terms above shall apply. In the event of late payment, AlbaJet reserves the right to charge interest on the outstanding amount at the rate of 4% per annum above the European Central Bank base rate, calculated on a daily basis from the due date until the date of payment. Where the Customer is a consumer within the meaning of applicable consumer protection law, the interest rate shall not exceed the maximum rate permitted by such law.
- 5.10
- If the Aircraft Operator cancels or withdraws from a confirmed Charter Contract for reasons other than those set out in clause 5.4, AlbaJet shall use its reasonable commercial endeavours to arrange a suitable replacement aircraft at no additional cost to the Customer. If no suitable replacement can be found, the Customer shall be entitled to a full refund of the Charter Price. AlbaJet shall not be liable for any indirect losses arising from such cancellation by the Aircraft Operator.
- 5.11
- AlbaJet and/or the Aircraft Operator reserve the right to substitute the aircraft type specified in the Charter Contract if operationally required. AlbaJet shall notify the Customer of any substitution as soon as reasonably practicable and shall endeavour to provide an aircraft of equivalent or higher category. Any price difference resulting from a substitution shall be communicated to the Customer.
- 5.12
- Any refund due to the Customer under these Terms shall be processed within 30 business days of the date on which the right to a refund arises, to the original payment method or bank account used by the Customer. Where a refund to the original payment method is not practicable, AlbaJet shall refund to a bank account nominated by the Customer.
- 5.13
- Any claim by the Customer arising under or in connection with these Terms or a Charter Contract must be notified to AlbaJet in writing within 28 days of the event giving rise to the claim. Failure to notify within this period does not extinguish the claim but may be taken into account in assessing the claim.
- 5.14
- Certain aircraft require the approval of the aircraft owner prior to a flight. Where this applies, it will be indicated in the Charter Contract. Owner's approval can in most cases only be requested once the Charter Contract has been signed and payment or deposit has been received in full. Owner's approval is not guaranteed. If owner's approval is denied, AlbaJet shall use its reasonable commercial endeavours to arrange a suitable alternative aircraft. If no suitable alternative can be found, the Customer shall be entitled to a full refund of the Charter Price.
- 5.15
- The Charter Price is based on the schedule, routing, and number of passengers specified in the Charter Contract. Any changes requested by the Customer to flight dates, routing, or passenger numbers are subject to aircraft availability and operational feasibility and cannot be guaranteed. Accepted changes may result in a revised Charter Price.
- 5.16
- Certain flights may require overflight or landing permits from the relevant authorities. AlbaJet and/or the Aircraft Operator will arrange such permits where required. However, the granting of permits is at the sole discretion of the relevant authorities and cannot be guaranteed. Delays or cancellations resulting from the refusal or late issuance of permits shall not give rise to any liability on the part of AlbaJet.
- 5.17
- Catering requests must be submitted to AlbaJet at least 48 hours prior to the scheduled departure time. Catering is arranged on a best-effort basis and is subject to availability and delivery capabilities at the departure airport. For requests submitted after this deadline or for short-notice bookings, catering may be limited or unavailable entirely. AlbaJet shall not be liable if requested catering cannot be fulfilled.
- 5.18
- The Flight Schedule set out in the Charter Contract has been prepared taking into account applicable crew duty and flight time limitation requirements. If, for reasons beyond the control of AlbaJet or the Aircraft Operator, it becomes necessary to provide additional crew or position replacement crew to complete the Flight Schedule, the Customer shall be liable for any additional costs incurred. AlbaJet shall not be liable for any delays resulting from crew duty time limitations.
- 5.19
- The captain of the Aircraft shall have complete discretion concerning the preparation of the Aircraft for flight, whether or not a flight shall be undertaken or abandoned once undertaken, any deviation from the proposed route, where landings shall be made, and all other matters relating to the safe operation of the Aircraft. The Customer shall accept all such decisions as final and binding.
- 5.20
- No set-off or counterclaim shall entitle the Customer to withhold payment of any sums payable to AlbaJet under these Terms or any Charter Contract.
- 5.21
- In the event of any delay directly caused by the Customer or any passenger, the Customer shall be liable for any demurrage or standing charges incurred by the Aircraft Operator, including but not limited to crew standby costs, overnight accommodation, and additional airport fees. Such charges shall be communicated to the Customer and are payable on demand.
- 5.22
- Where the Charter Price is quoted in a currency other than the currency of the Charter Invoice, AlbaJet shall convert the amount at the prevailing exchange rate at the time of invoicing. A currency conversion fee of 2% shall apply to cover exchange rate fluctuations. The Customer bears all currency exchange risk between the date of the Charter Contract and the date of payment.

De-Icing
In the case of aircraft de-icing costs (including aircraft hangarage), the Customer shall be fully responsible for reimbursing the Aircraft Operator for these costs, unless a De-Icing Waiver has been purchased and specified in the Charter Contract.
If the Customer does not purchase a De-Icing Waiver, AlbaJet shall require a credit card hold for the approximate costs of potential de-icing. If the Customer fails to provide a credit card hold for the de-icing costs, the Customer agrees that AlbaJet shall be entitled to request payment for the de-icing sum.

Airport Slot Variations
AlbaJet and the Aircraft Operator will endeavour to secure airport slots as close to the requested times as possible. However, due to airport regulations and slot availability, the actual slots may vary. Many airports only allocate slots shortly before departure. The Customer will be notified of any significant changes to the scheduled times. AlbaJet is not liable for delays or alterations resulting from slot availability or airport regulations.

Passenger Punctuality and Waiting Time
No waiting time is guaranteed unless explicitly stated in the Charter Contract. It is the responsibility of the Customer and passengers to be on time for their scheduled departures. Delays caused by late arrival of passengers attributable to the Customer may result in additional waiting charges, repositioning charges, or, if the Aircraft Operator cannot reasonably wait, loss of the flight sector without compensation. AlbaJet and the Aircraft Operator are not responsible for delays or consequences resulting from the passengers' failure to arrive on time.

Passenger Conduct
The Aircraft Operator and/or AlbaJet reserve the right to refuse carriage to any passenger whose conduct is disorderly, abusive, or who appears to be under the influence of alcohol or drugs to an extent that may pose a safety risk. Smoking, including the use of electronic cigarettes, is strictly prohibited on all charter flights unless explicitly permitted by the Aircraft Operator. The Customer is responsible for ensuring that all passengers comply with the instructions of the flight crew at all times.
The Customer represents and warrants that neither the Customer nor any passenger is the subject of any applicable sanctions, and that the charter flight will not be used in breach of any anti-money laundering, sanctions, or anti-bribery regulations. AlbaJet reserves the right to cancel any Charter Contract without liability and refund the Charter Price in full if, at any time, AlbaJet's compliance checks (including KYC, AML, or sanctions screening) cannot be satisfactorily completed.
Photography and filming inside the Aircraft is only permitted with the prior written permission of AlbaJet and the agreement of the flight crew.
The carriage of animals is only permitted with prior written approval from AlbaJet. Where approved, the Customer is responsible for ensuring all required veterinary and travel documentation is in order, that the aircraft cabin is adequately protected, and shall be liable for any additional cleaning or restoration costs resulting from the carriage of animals.

Baggage and Prohibited Items
Passengers must comply with all applicable baggage weight limits and restrictions as communicated by AlbaJet on behalf of the Aircraft Operator. Baggage allowance is limited by the aircraft type and operational requirements. If passengers arrive with baggage exceeding the permitted weight or volume, the Aircraft Operator may refuse to load excess items. AlbaJet shall not be liable for baggage left behind due to weight or space restrictions.
The carriage of dangerous goods, hazardous materials, firearms, or any items prohibited by applicable aviation regulations is strictly forbidden.
AlbaJet, as intermediary, shall not be liable for any loss of, or damage to, passenger baggage or personal belongings. Any claims for baggage loss or damage should be directed to the Aircraft Operator, whose liability as carrier is governed by applicable aviation law.

Responsibility for Costs of Diversions and Fuel Stops
In the event of a flight diversion due to weather conditions, air traffic control instructions, airport or authority restrictions, passenger acts or omissions, or other circumstances outside the reasonable control of AlbaJet and the Aircraft Operator, the Customer shall be responsible for all additional costs incurred. This includes, but is not limited to, costs associated with reaching the final destination, additional fuel, landing fees, and accommodation for crew and passengers if necessary. AlbaJet will provide a detailed breakdown of these additional costs to the Customer.
Unplanned fuel stops may become necessary due to weather conditions, headwinds, payload weight, or aircraft performance requirements. AlbaJet will use its reasonable commercial endeavours to identify and inform the Customer of potential fuel stops in advance, but this is not always possible. Any additional costs resulting from such fuel stops, including landing fees and additional fuel, shall be borne by the Customer.

Insurance
The Aircraft Operator is required to maintain adequate aviation insurance in accordance with applicable regulations. AlbaJet strongly recommends that the Customer and all passengers obtain comprehensive travel insurance, including coverage for trip cancellation, medical emergencies, and repatriation. AlbaJet shall not be liable for any losses that would have been covered by such insurance.

Third-Party Services
AlbaJet may, as a courtesy, assist the Customer in arranging third-party services such as ground transportation or special requests. Such services are provided by independent third parties and AlbaJet acts solely as an intermediary in facilitating these arrangements. AlbaJet shall not be liable for the quality, performance, or non-performance of any third-party service.

Confidentiality
The Charter Price, payment terms, and other commercial terms contained in the Charter Contract are confidential to the parties and shall not be disclosed by either party to any third party without the prior written consent of the other party, except as required by applicable law or to such party's accountants, bankers, or legal advisers. Where the Customer enters into a Charter Contract as agent for or on behalf of another person or entity, the Customer's and that person's or entity's liability under these Terms shall be joint and several.

Data Protection
AlbaJet collects and processes personal data, including but not limited to passenger names, contact details, passport information, and payment details, as necessary for the performance of the Charter Contract and AlbaJet's legitimate interest in arranging and facilitating charter flights. Personal data may be shared with Aircraft Operators, ground handlers, and relevant authorities as required for the operation of the flight and compliance with applicable law.
AlbaJet handles all personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and, where applicable, the Swiss Federal Act on Data Protection (FADP). Full details of how AlbaJet processes personal data, including data retention periods, data subject rights, and international transfers, are set out in AlbaJet's Privacy Notice available at www.albajet.com/privacy.
The Customer agrees that it is authorised to provide passenger personal data to AlbaJet and shall ensure that all passengers have been informed of how their data will be processed in connection with the charter flight.

Limitation of Liability
AlbaJet acts as an intermediary and not as a carrier. AlbaJet's total aggregate liability to the Customer under or in connection with these Terms and any Charter Contract, whether arising in contract, tort, or otherwise, shall not exceed the total Charter Price paid by the Customer for the relevant booking. AlbaJet shall not be liable for any indirect, consequential, or special damages, including but not limited to loss of profits, loss of business, or loss of opportunity.
Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) wilful misconduct or gross negligence; or (d) any liability which cannot be limited or excluded by applicable law.
The liability of the Aircraft Operator as carrier is governed by the applicable aviation liability regime, including the Montreal Convention where applicable, and is not limited or affected by these Terms.

Indemnification
The Customer shall indemnify and hold harmless AlbaJet, its directors, officers, and employees from and against any claims, losses, damages, liabilities, and expenses arising out of or in connection with the Customer's or any passenger's breach of these Terms, failure to comply with applicable laws or regulations, or any act or omission of the Customer or any passenger, except to the extent caused by AlbaJet's own negligence or wilful misconduct.

Assignment
The Customer may not assign or transfer any rights or obligations under these Terms or any Charter Contract to a third party without the prior written consent of AlbaJet. AlbaJet may assign or transfer its rights and obligations under these Terms to any successor entity or affiliate.

Dispute Resolution
In the event of a dispute, the parties agree to seek resolution through negotiation. If unresolved, disputes shall be subject to the non-exclusive jurisdiction of the courts at the registered office of AlbaJet Charter GmbH, applying Austrian law.

Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Language
These Terms are available in English, German, Spanish, and Italian. In the event of any discrepancy or conflict between the language versions, the English version shall prevail.

General Provisions
AlbaJet reserves the right to amend these Terms from time to time. Amendments shall apply to bookings made after the date of amendment. Any changes to an executed Charter Contract shall require the written agreement of both parties.
Any modification to a Charter Contract, including but not limited to changes to flight times, routing, or passenger details, shall be valid and binding on both parties provided it is agreed in text form (e.g. by email or via an official AlbaJet communication channel). Such agreed modifications shall prevail over any conflicting terms in the original Charter Contract. Oral agreements shall not be binding unless confirmed in text form.
No failure or delay by AlbaJet in exercising any right under these Terms shall operate as a waiver of that right.
Any notice required under these Terms shall be given in writing by email or registered post to the contact details provided in the Charter Contract and shall be deemed received upon proof of delivery.
These Terms do not confer any rights on any third party, including any passenger who is not the Customer.
Nothing in these Terms shall affect the statutory rights of the Customer under applicable consumer protection law.
These Terms, together with the Charter Contract, constitute the entire agreement between the parties.
When these terms mention "AlbaJet", "we", "us", or "our", it refers to AlbaJet Charter GmbH (company number: FN 512330 b) registered at Villacher Straße 26, Velden am Wörthersee, 9220 Austria and governed by Austrian law.
